Kupang.SpektrumNtt.com || Diduga Badan Pertanahan Nasional (BPN) Kabupaten Kupang tidak melakukan pengukuran tanah/lahan milik Soleman Amnahas di RT/RW.016/007, Desa Oeltua, Kecamatan Taebenu. Namun anehnya, BPN Kabupaten Kupang menerbitkan Gambar Situasi (GS) fiktif sebagai dasar penerbitan 2 Sertifikat Hak Milik (SHM) di atas lahan tersebut atas nama Markus Tumbonat dan Daniel Amnahas.

Demikian dikatakan Pengacara Soleman Amnahas, Samuel Haning, SH kepada Tim Media ini pada Sabtu (24/07/21) di lokasi sengketa.

“Kami yakin, BPN Kabupaten Kupang tidak melakukan pengukuran di tanah ini. Karena keluarga Soleman Amnahas menunggu di lokasi ini untuk diukur tapi petugas pengukur tanah dari BPN tidak melakukan pengukuran dengan seribu satu alasan. Tapi anehnya, lembaga tersebut menerbitkan GS fiktir sebagai dasar penerbitan 2 Sertifikat Hak Milik (SHM) ‘Aspal’ atas nama orang lain, yakni atas nama Markus Tunbonat dan .... Amnahas,” ungkap pengacara yang biasa disapa Paman Sam.

Menurut Paman Sam, BPN Kabupaten Kupang tidak melaksanakan prosedur tetap (protap) sebagaimana aturan yang berlaku. “Tidak ada pengukuran kok ada GS? Airtinya GS yang dijadikan dasar penerbitan 2 SHM atas nama Markus Tunbonat dan Daniel Amnahas itu fiktir. Ini yang namanya ‘mafia tanah’. Sesuai perintah Presiden Jokowi, ‘mafia tanah’ ini harus diberantas,” jelasnya. 

Pihaknya, lanjut Paman Sam, memiliki bukti-bukti dan saksi kunci bahwa tanah yang disengketakan itu tidak pernah diukur oleh BPN Kabupaten Kupang. “Banyak hal yang janggal dalam proses penerbitan 2 sertifikat di atas lahan sekitar 1 Ha ini. Dari GS dalam SHM itu terlihat bahwa BPN mengada-ada. Tidak ada jalan kok, dibuat seolah-olah ada jalan. Ini jelas-jelas rekayasa petugas BPN bekerjasama dengan aparat desa setempat. Nggak benar ini,“ tandasnya.

Karena itu, beber Paman Sam, kliennya telah mengajukan gugatan pembatalan SHM di Pengadilan Tata Usaha Negara (PTUN) Kupang. “Masalah ini sedang dalam persidangan. Kami harap Majelis Hakim yang terhormat dapat menguak misteri dibalik penerbitan SHM ‘Aspal’ tersebut dan mencabut 2 SHM ‘Aspal’ tersebut. Sehingga tanah tersebut dikembalikan kepada klien saya sebagai pemilik sah atas tanah tersebut,” ujarnya.

Seperti diberitakan sebelumnya, Kuasa Hukum Soleman Amnahas, Samuel Haning menduga ada ‘Mafia Tanah’ yang melibatkan oknum aparat Badan Pertanahan Nasional (BPN) Kabupaten Kupang dan aparat Desa Oeltua, Kecamatan Taebenu, Kabupaten Kupang. ‘Mafia Tanah’ ini dituding telah merampas lahan milik Soleman Amnahas warga Desa Oeltua dengan luas sekitar 4.000 m2.

Menurut Paman Sam, dugaan adanya ‘Mafia Tanah’ tersebut terkuak setelah ada pihak yang menunjukan Sertifikat Hak Milik (SHM) atas nama Markus Tunbonat pada lahan milik Soleman Amnahas. “Tiba-tiba 2 minggu yang lalu sudah ada orang yang membersihkan lahan tersebut dan menunjukan sertifikat tanah an. Markus Tombonat. Maka pandangan kami sebagai Kuasa Hukum, diduga ada ‘Mafia Tanah’ yang dilakukan oknum-oknum yang merampas hak milik Bpk. Soleman Amnahas yang tidak sesuai prosedur hukum,” ungkap Paman Sam.

Paman Sam menjelaskan, Soleman Amnahas telah mengajukan permohonan Sertifikat Hak Milik (SHM) melalui prona pada tahun 2018 tidak diproses oleh BPN Kabupaten Kupang. Namun tanpa sepengetahuan pemilik lahan, BPN Kabupaten Kupang telah menerbitkan Sertifikat Hak Milik (SHM) atas nama pihak lain, yakni Markus Tunbonat.

“Pihak keluarga menunggu untuk proses pengukuran sejak 2018, tapi tidak diukur oleh BPN. Alasannya tidak jelas. Tapi kog bisa keluar SHM lahan tersebut (pada tahun 2019, red) atas nama orang lain? Ini memang aneh,” ujar Paman Sam yang mendampingi Soleman Amnahas dan 3 orang anaknya.

Menurut Paman Sam, Petugas seksi pengukuran BPN Kabupaten Kupang tidak pernah melakukan pengukuran tanah sengketa tersebut. “Kapan mereka turun ke lokasi untuk ukur sehingga bisa terbitkan sertifikat atas nama Markus Tunbonat? Kan tidak pernah ada pengukuran di lokasi tersebut oleh BPN, tapi kenapa ada surat ukur dan terbit sertifikat? Diduga adanya pengukuran yang tidak sah terhadap lahan tersebut oleh BPN Kabupaten Kupang,” ungkapnya.

Paman Sam juga membeberkan sejumlah bukti kepemilikan lahan tersebut. “Perlu kami sampaikan bukti-bukti sudah jelas, ada bukti pembayaran pajak atas nama Soleman Amnahas dari tahun 1960 sampai 2021. Ada surat pernyataan dari Kepala Desa sendiri yang menyatakan bahwa tanah itu milik Soleman Amnahas. Pada tanggal 4 Mei 2020, Kepala Dusun dan RT juga menyatakan bahwa tanah itu milik Bapak Soleman Amnahas,” tegasnya.

Lahan tersebut, jelas Paman Sam, merupakan tanah yang diwariskan secara turun-temurun. “Soleman Amnahas mendapatkan tanah tersebut dari dari ayahnya. Soleman Amnahas juga membayar Pajak Bumi dan Bangunan (PBB) sejak tahun 1960. Sebelumnya, PBB tanah itu dibayar oleh ayah Soleman. Buktinya ada. Pada tanggal 18 Mei 2021, Soleman Amnahas masih bayar pajak. Ini bukti bahwa Soleman Amnahas telah membayar pajak,” ujarnya sambil menunjukan bukti pembayaran PBB sejak tahun 1960 hingga 2021.

Dijelaskan, Soleman Amnahas tidak pernah memberikan tanah kepada Markus Tunbonat dan pihak lain baik secara hibah maupun pelepasan hak. “Juga tidak pernah memperjualbelikan tanah tersebut kepada siapapun. Selain itu, tidak ada hubungan ahli waris antara Soleman Amnahas dan Markus Tunbonat. Kalau ada pihak-pihak yang klaim tanah itu miliknya, mari kita tunjuk bukti,” tantang Advokat berkepala plontos itu. (SN /tim)
