Frans Foes dari isteri pertama, red) akhirnya angkat bicara menanggapi pernyataan Camat Alak, Yulianus Willem Pally sebelumnya pada Rabu, (10/01/2023) lalu, yang menolak menandatangani dan mengeluarkan Pelepasan Hak (PH) untuk YEB atas tanah warisan seluas 75 Hektare (Ha) di Oenunu, Kelurahan Batuplat, Kecamatan Alak, Kota Kupang, NTT.

 

Dalam keterangannya kepada media ini, Selasa, (15/4/2025) Aleksi menegaskan bahwa pernyataan Camat Alak membuktikan adanya polemik hukum yang belum tuntas dalam perkara tersebut, dan menegaskan kembali bahwa tanah itu jelas milik keluarga Foes-foes. Bukan milik perorangan.

 

“Kami sangat menghargai sikap Camat Alak yang tidak serta merta mengeluarkan atau menandatangani PH atas dasar surat yang sudah disengketakan. Itu menunjukkan bahwa beliau cukup berhati-hati dan adil dalam menyikapi persoalan ini,” ujar Aleksi kepada tim media.

 

Lebih lanjut, Aleksi menegaskan bahwa langkah hukum tetap akan ditempuh pihak keluarga Foes untuk meluruskan kebenaran atas hak kepemilikan lahan yang telah diwariskan turun temurun dari alm. Frans Foes.

 

“Tapi kami juga tidak bisa diam ketika pihak lain seperti YEB mengklaim seluruh 75 Ha hanya berdasarkan selembar foto kopi surat yang kami duga kuat palsu. Kalau hanya modal foto kopi dan bisa menang di pengadilan, itu sangat tidak adil. Maka kami akan terus kawal proses ini, baik secara hukum pidana maupun perdata,” tegasnya.

Terkait putusan pengadilan sebelumnya yang memenangkan YEB atas tanah seluas 3.000 meter persegi, Aleksi menyebutkan bahwa keputusan tersebut tidak bisa dijadikan dasar klaim atas seluruh lahan 75 Hektare.

“Itu putusan terbatas, hanya 3.000 meter pun dia (YEB, red) tak tahu batasnya dimana. Karena itu pun masih dalam tanah milik saya seluas 6.000 meter persegi atas nama jelas Aleksi Aleksander Tolaik. Bagaimana bisa kemudian dia klaim seluruh tanah? Bahkan ada kuburan keluarga kami yang digali, rumah kami dirobohkan. Apakah semua itu bisa dibenarkan hanya dengan berbekal surat foto kopi? Ini pertanyaan besar soal keadilan di negeri ini,” tegas Aleksi dengan nada kecewa.

Diberitakan sebelumnya, laporan dugaan pemalsuan dokumen Surat Penyerahan Hak oleh YEB telah dilaporkan oleh Aleksi ke Polres Kupang Kota dengan nomor STTLP/234/III/2022 tertanggal 24 Maret 2022. Namun hingga kini, pihak keluarga mempertanyakan lambannya penanganan perkara tersebut.

“Kami sudah lapor dari tahun 2022, tapi sampai hari ini belum ada kejelasan. Padahal ini soal hak kami sebagai warga negara dan sebagai ahli waris sah. Kami hanya minta keadilan,” pungkas Aleksi.

Sebelumnya, Penyidik Polres Kupang Kota, Leo Rihi, mengakui bahwa dokumen asli surat penyerahan hak yang dijadikan dasar klaim oleh YEB hingga kini belum ditemukan. Bahkan dari hasil gelar perkara yang dilakukan pihak kepolisian, disarankan untuk dilakukan pencocokan data atau perbandingan dengan arsip di kantor Kecamatan dan Kelurahan.

Dengan semua fakta ini, keluarga Foes melalui Aleksi Taloik mendesak aparat penegak hukum dan pemerintah agar bertindak objektif dan tidak memberi ruang pada praktik-praktik manipulatif yang merampas hak rakyat kecil.

“Kami siap buka semua bukti. Kami tidak takut. Tapi jangan ada pembiaran terhadap pelanggaran hukum. Negara harus hadir dan melindungi kami yang menjadi korban,” tandas Aleksi menutup keterangannya. Tim ***
