Kupang.Spektrum-Ntt.com ||Samuel Haning SH.,M.H, selaku Kuasa Hukum Soleman Amnahas akhirnya melaporkan (laporan pengaduan, red) Kepala Unit (Kanit) Resort Kriminal (Reskrim) Kepolisian Sektor (Polsek) Kupang Tengah, Pance P. Sopacua ke Polda NTT karena menolak laporan pengaduan masyarakat (a.n. Soleman Amnahas, red) tentang dugaan adanya tindak pidana mafia tanah di desa Oeltua oleh Markus Tunbonat, yang diduga melibatkan sejumlah oknum Pemerintah Desa Oeltua, Pemerintah Kecamatan Taebenu dan Polisi.  

Demikian disampaikan Kuasa Hukum Soleman Amnahas, Samuel Haning, SH., MH melalui rilis tertulis kepada tim media ini di Kupang pada Senin (30/05/21).

"Laporan ini diterima oleh Kabid Humas Polda NTT, Rishian Krisna B. SH,. SIK. MH Pada hari Senin, 24/05/2021 di Polda NTT sekitar Jam 09:20 Wita," tulisnya dalam rilis.

Menurut Samuel Haning, polisi tidak boleh menolak laporan masyarakat. Polisi harus menggunakan aturan hukum KUHP Pasal 1 ayat 24 dan ayat 25 pasal 13, pasal 14 pasal 15 Peraturan Kepala Kepolisian Republik Indonesia Nomor 6 tahun 2019. "Namun Kanit Reskrim Kupang Tengah Pance Sopacua bersikeras menolak laporan," tandasnya.

Kalau polisi, lanjut Sam Haning, menerima laporan pidana, kemudian melakukan penyelidikan dan hasil penyidikan tidak cukup bukti, dan bahwa itu bukan kasus pidana tetapi kasus perdata, mungkin bisa membuat SP2HP atau SP3. Tentunya masyarakat menerima, tetapi yang terjadi justru Polisi (Kanit Reskrim Kupang Tengah, red) tetap menolak laporan masyarakat (Soleman Amnahas,red) .

Sam Haning menambahkan, bahwa padahal saat itu (setelah datang melapor dan laporan ditolak Kanit Reskrim, 23/05/21, red), sekitar pukul 13: 20 Wita, dirinya dan Soleman Amnahas hendak kembali, tetapi datanglah Kapolsek Kupang Tengah yang memfasilitasi masyarakat dan Kanit Reskrim untuk menerima laporan masyarakat. Tetapi Kanit Reskrim Pance P. Sopacua tetap tidak mau menerima laporan masyarakat itu.

"Ada apa dibalik anggota Polri ini yang bersikeras tidak mau terima laporan itu? Padahal tugas polisi itu jelas, melindungi, mengayomi masyarakat, tetapi Kanit Reskrim ini penilaian kami justru merusak citra Polri di mata masyarakat," beberapa Advokat yang biasa disapa Paman Sam itu.

Paman Sam berpendapat, bahwa Kanit Reskrim Pance P. Sopacua telah mencederai lambang Tri Brata dengan melakukan pelecehan/pelanggaran HAM terhadap masyarakat sebagaimana keputusan Kepala Kepolisian RI Nomor 8 tahun 2009 Bab 1 pasal 1 ayat 7.

"Pelanggaran HAM adalah setiap perbuatan seseorang atau kelompok termasuk aparat negara baik sengaja ataupun tidak sengaja atau kelalaian yang melawan hukum, mengurangi, menghalangi, membatasi dan atau mencabut HAM seseorang atau kelompok orang yang dijamin oleh UU dan tidak mendapatkan, atau dikwatirkan tidak memperoleh penyelesaian hukum yang adil dan benar berdasarkan mekanisme hukum yang benar," jelasnya dalam rilis.

Lebih lanjut, Paman Sam meminta Kapolri Jenderal Polisi Listyo Sigit Prabowo untuk menindak tegas Kepala Desa Oeltua, Daniel Manael dan Camat Taebenu, Eliaser Malesi yang diduga terlibat dalam mafia tanah di Oeltua.

Paman membeberkan, bahwa untuk mendukung program kerja Kepolisian Negara Republik Indonesia tentang mafia tanah, maka masyarakat atas nama Soleman Amnahas sebagai pemilik tanah telah mengajukan pengajuan sertifikat tanah melalui Proyek Operasional Nasional Agraria sejak tahun 2018, 2019, 2020 dan 2021. Pengajuan itu melalui Kepala Desa Oeltua Kecamatan Taebenu Kabupaten Kupang dengan syarat administrasi lengkap.

"Pemilik tanah Soleman Amnahas bersama anak-anaknya menunggu di lokasi/tanah yang mau diukur. Namun dari pihak Pertanahan Kabupaten Kupang tak kunjung tiba. Dengan dasar itu tidak ada pengukuran bidang tanah dimaksud,” paparnya.

Namun, lanjutnya, pada tahun 2019, terbit sertifikat tanah tersebut atas nama orang lain yakni Markus Tunbonat yang bukan pemilik tanah sebenarnya. “Tanah itu adalah milik Soleman Amnahas karena dibuktikan dengan pembayaran Pajak Bumi dan Bangunan (PBB) sejak tahun 1961 hingga 2021," urainya.

Oleh karena itu, tulis Sam Haning lebih lanjut, pemilik tanah mempertanyakan kepada Kepala Desa Oeltua, Camat Taebenu dan Badan Pertanahan Kabupaten Kupang; "siapa-siapa yang melakukan pengukuran tanah itu sehingga sertifikat bisa diterbitkan atas nama orang lain? Dasar apa yang membuat pihak Pertanahan menerbitkan sertifikat. 

Pihak pertanahan melakukan pengukuran sejak tahun 2018 dan pemilik tanah atas nama Soleman Amnahas bersama anak-anak mengikuti tim dari Pertanahan yang melakukan pengukuran. Sayangnya, saat itu tanah tersebut tidak sempat diukur. Herannya kemudian sertifikat bisa terbit namun atas nama Markus Tunbonat yang bukan pemilik tanah itu. 

Berdasarkan kronologis di atas, lanjut Sam Haning, pada tanggal 23/05/2021, sekitar pukul 12:30, dirinya mendampingi keluarga Soleman Amnahas untuk membuat laporan polisi di Polsek Kupang Tengah atas dugaan adanya dugaan tindak pidana mafia tanah.

Namun, Kanit Reskrim Kupang Tengah, Pance P. Sopacua yang saat itu ditemui Sam Haning dan kliennya bersama beberapa orang wartawan, lalu berdiskusi terkait laporan dimaksud langsung mengatakan menolak laporan karena obyek sengketa/tanah itu sudah bersertifikat.

"Kedatangan saya bersama klien saya (Soleman Amnahas, red) dengan tujuan dugaan kami bahwa sertifikat itu diperoleh tidak sesuai prosedur dengan melakukan pemalsuan sejumlah dokumen. Namun Kanit Reskrim tetap bersikeras tidak menerima laporan masyarakat itu," ungkapnya. (TIM)
