Spektrum-Ntt.com || Keluarga besar Tolaik dengan tegas menolak rencana pengukuran ulang tanah milik mereka oleh Badan Pertanahan Nasional (BPN) Kota Kupang yang dikawal aparat kepolisian dan sejumlah orang tak dikenal yang disebut sebagai preman. Penolakan ini terjadi saat rombongan BPN dan pihak YEB mendatangi lokasi tanah milik keluarga Tolaik di wilayah Oenunu, Kelurahan Batuplat, Kecamatan Maulafa, Kota Kupang, pada Rabu (16/4/2025).

Tanah seluas satu hektar yang disengketakan ini termasuk telah memiliki sertifikat resmi yang diterbitkan oleh BPN Kota Kupang, dan telah diukur secara resmi pada 13 Juli 2022. Pengukuran saat itu dilakukan atas permintaan resmi dari pihak Polda NTT untuk keperluan penyelidikan, dan disaksikan oleh pihak kepolisian, lurah, RT/RW, pemilik lahan, serta para pemilik batas. Proses tersebut dinyatakan selesai dan diterapkan dalam berita acara resmi yang ditandatangani semua pihak.

Namun, kehadiran pihak BPN bersama YEB dan aparat kembali untuk melakukan pengukuran ulang menuai protes keras dari Keluarga Tolaik. "Jangan cuma andalkan polisi dan preman. Polisi juga ikut saja? Padahal sudah ukur resmi pada 13 Juli 2022, dan saat itu polisi juga ada. Tapi sekarang datang ukur lagi? Kasus ini kan sudah SP3 di Polresta Kupang, kenapa datang lagi?" tegas perwakilan Keluarga Tolaik di lokasi kejadian.

Dalam orasinya, keluarga besar Tolaik menilai netralitas BPN Kota Kupang. Mereka menyanyangkan sikap lembaga yang sebelumnya telah menerbitkan sertifikat tanah kepada mereka, namun kini kembali melakukan pengukuran ulang atas permintaan pihak lain.

"BPN lagi. Sebenarnya BPN berpihak pada siapa? Apakah dengan uang? Ini sertifikat ada lambang Garuda, bukan sembarangan," seru anggota keluarga dalam protes terbuka.

Keluarga Tolaik juga menantang YEB untuk menunjukkan bukti kepemilikan serta batas-batas lahan seluas 3.000 meter persegi yang diklaimnya berada di wilayah tanah keluarga Tolaik.

"Tunjukkan bukti. Mana tanahmu 3.000 meter persegi itu? Batas batasnya. Penggusuran yang pernah dilakukan dulu itu pihak. Tidak ada Pemeriksaan Setempat dari hakim, kok tiba-tiba gusur. Kami punya sertifikat masih aktif sampai sekarang, tak pernah dimatikan siapa pun," ujar salah satu anggota keluarga.

Keluarga juga menyoroti kehadiran aparat dan orang tak dikenal yang datang tanpa surat tugas resmi, apalagi di hari libur yang bertepatan dengan persiapan perayaan Paskah bagi umat Kristiani.

"Datang main ukur-ukur saja. Di sini ada pemilik tanah. Minta izin sedikit. Mana surat yang dijelaskan?" tandas mereka.

Penasehat Hukum keluarga Tolaik yang turut hadir secara resmi dalam aksi tersebut juga memberikan tanggapan kritis. Ia menekankan pentingnya etika dan prosedur hukum yang harus dihormati semua pihak.

"Saya hadir secara resmi sebagai pengacara. Harus berbicara dengan hormat dan beretika. Di sini ada pemerintah. Apakah pihak mereka datang sudah izin RT/RW? Lalu soal BPN, harusnya beri penjelasan netral. Karena BPN sendiri sudah pernah mengukur tanah ini. Kalau ukur ulang, apa kalian tidak yakin dengan hasil kalian sendiri?" ucapnya.

Ia juga mengungkapkan kehadiran aparat kepolisian.

Pak Dance (anggota polisi, red) juga hadir pada waktu pengukuran resmi itu. Jadi jangan saling berkelahi. Negara ini punya hukum, mari kita hormati dan jarak jalur hukum dengan kepala dingin, tambahnya.

Sementara itu, pihak Yeri Bilik dalam keterangannya di tengah ketegangan mengaku bahwa pengukuran ulang dilakukan atas dasar laporan polisi mengenai dugaan penyerobotan tanah. Ia menyebut bahwa lahan tersebut telah dilaksanakan pada tahun 2017, namun terjadi pembangunan kembali di atas lahan itu, sehingga perlu dilakukan pemeriksaan batas.

"Sesuai dengan laporan polisi terkait penyerobotan. Karena ini sudah dieksekusi tahun 2017, lalu ada pembangunan lagi. Maka dalam rangka pengembangan penyelidikan, polisi datang untuk melihat batas-batas lahan sesuai gugatan," jelas Yeri Bilik.

Pernyataan tersebut langsung disampaikan oleh pihak keluarga Tolaik yang menyatakan bahwa laporan tersebut telah dinyatakan selesai dengan SP3 (Surat Perintah Penghentian Penyidikan) oleh Polresta Kupang.

"Laporannya sudah SP3. Tanah ini kami masih membayar pajak sampai sekarang. Kau punya tanah di mana? Yang kau gusur itu milik kami," balas keluarga Tolaik dengan tegas.

Sengketa ini juga ikut mengangkat nama keluarga besar Foes-foes yang menyatakan bahwa tanah di wilayah tersebut seluas 75 hektare masih merupakan tanah warisan keluarga yang belum pernah dibagikan secara resmi. Aleksi Aleksander Simson Taloik, pemegang kuasa dari almarhumah Yuliana Foes (anak kandung Frans Foes dari istri pertama), menyatakan bahwa tanah tersebut adalah hak keluarga besar, bukan hak pribadi.

Sebelumnya, Camat Alak juga telah menegaskan tidak akan menandatangani dokumen Pelepasan Hak (PH) atas tanah yang dijual secara sepihak oleh oknum yang mengatasnamakan pribadi, bukan atas nama sah keluarga Foes. Tim***
